2. Scope and Acceptance of the Terms of Use
The provisions of these Terms of Use, in particular those relating to the limitation of liability, shall apply to the use of the website as well as to accessing, viewing, and using the map material and all other content and functions provided on the website by any user, regardless of whether the user is registered or otherwise has a contractual relationship with Top-O-Map TOM GmbH. For the purposes of these Terms of Use, a “user” means any natural or legal person who accesses or uses the website or the map material. By accessing or using the map material for the first time, the user accepts these Terms of Use. The Terms of Use are available on the website at any time via the link in the footer and are additionally displayed when the map material is accessed for the first time.
3. Not Intended as a Basis for Safety-Critical Decisions
The elevation data, contour lines, and terrain profiles displayed on this website are intended for general orientation only. They do not replace official maps, up-to-date weather information, or professional route planning. For safety-critical decisions – such as mountain tours, expeditions, or activities in difficult terrain – suitable, current, and official sources of information as well as personal knowledge of local conditions must also be consulted.
4. Source of the Map Data
The underlying map data is sourced from external sources. Errors, missing map elements, or other inaccuracies in this data cannot be ruled out. No liability is assumed for the accuracy of the map data. Errors in the map data can be reported directly to OpenStreetMap.
5. Liability for Links
This website may contain links to third-party websites. The respective provider is solely responsible for the content of such websites. At the time the links were created, no legal violations were apparent. We do not permanently monitor the content of linked websites. If we become aware of any legal violations, the affected link will be removed immediately.
6. Changes & Availability
The operator reserves the right to modify, supplement, or remove content, functions, and the presentation of the map at any time without prior notice. There is no entitlement to the permanent availability of the website or individual map areas. Temporary outages or technical disruptions cannot be ruled out.
7. Liability
The provisions set out in Sections 1 to 6 above are supplemented and limited by the following provisions. In the event of any conflict, the following provisions shall prevail.
7.1 Unlimited Liability
Top-O-Map shall be liable to users without limitation for any damage resulting from injury to life, body, or health caused by a breach of duty attributable to Top-O-Map, its legal representatives, or its vicarious agents, as well as for any other damage resulting from an intentional or grossly negligent breach of duty or fraudulent conduct by any of the aforementioned persons. Furthermore, Top-O-Map shall be liable without limitation to the extent that liability cannot be excluded or limited under mandatory statutory provisions, in particular under the German Product Liability Act (Produkthaftungsgesetz), as well as in cases where Top-O-Map has expressly assumed a guarantee.
7.2 Liability in Cases of Ordinary Negligence
In the event of a slightly negligent breach of a material contractual obligation, Top-O-Map shall only be liable for damages that are foreseeable and typical for the type of service provided. Material contractual obligations are obligations whose fulfillment is essential for the proper performance of the contract and on whose compliance the user may regularly rely. In the event of a slightly negligent breach of an obligation that is not material to the achievement of the contractual purpose, liability shall be excluded.
7.3 Other Liability
Subject to the provisions of Sections 7.1 and 7.2, Top-O-Map's liability for claims for damages, irrespective of the legal basis, shall be excluded unless otherwise provided for in these Terms of Use. This exclusion shall not apply to cases of intent or gross negligence or to the cases specified in Section 7.1.
